Terms and Conditions for We Make Footballers® (Global Baseline)

1. Definitions

1.1 "Carer" means the person/persons who attend the Course or any part of it with the Player.

1.2 "Parent" means a parent or legal guardian who will be responsible for the payment of the Fees and who is the contracting party to this contract.

1.3 "We Make Footballers" / "WMF" means the company with whom you have entered into this agreement.

1.4 "Course" means the We Make Footballers training sessions described on the website.

1.5 "Enrolment Form" means the form used to enrol or re-enrol the Player on the Course.

1.6 "Fee" means the monetary cost per Course as specified on the Enrolment Form.

1.7 "Coach" means the individual(s), contracted or employed by WMF, who teach the Course.

1.8 "Premises" means the venue where the Course takes place.

1.9 "Pupil" / "Player" means the child attending the Course.

1.10 "Terms" means these Terms and Conditions, including any special terms agreed in writing.

1.11 "Make-Up Class" means any additional session granted under these Terms when a class is missed.

2. Acceptance of Terms

2.1 All agreements relating to the teaching of the Course by WMF are subject exclusively to these Terms.

2.2 No variation is binding unless agreed in writing by WMF and the Parent.

2.3 These Terms are deemed accepted when the Parent pays the Fee. Payment by a Carer counts as payment on behalf of the Parent.

2.4 The Parent and/or Carer agree not to reproduce, distribute, or commercially exploit any proprietary WMF training materials, methodologies, or syllabus content without WMF's prior written consent. This clause does not restrict Parents or Carers from discussing their child's participation in WMF sessions or sharing non-proprietary content.

2.5 Continued attendance after updates to these Terms constitutes acceptance of the revised Terms.

3. Bookings, Payments & Make-Up Classes

3.1 WMF will not accept children who arrive without a prior booking. One trial session may be attended (free or paid depending on location). Continued attendance requires a subscription.

3.2 All participants must be pre-registered; spaces are first-come, first-served.

3.3 Booking confirmations and receipts are sent to the email provided. WMF is not responsible for incorrectly entered email addresses.

3.4 WMF does not issue refunds or credits except where required by applicable law.

3.5 A Course is booked for a set number of sessions. Renewal is automatic unless cancelled.

3.6 Missed sessions are not eligible for free, additional, or make-up sessions unless specified otherwise.

3.7 Payments are processed online via Stripe, GoCardless, or other approved processors.

3.8 Subscriptions renew automatically unless cancelled by the Parent through the Parent Area. By booking, the Parent agrees to recurring subscription charges until the subscription is cancelled.

4. Cancellation

4.1 Where WMF cancels a scheduled session, WMF will notify the Parent as soon as reasonably practicable. Where WMF cancels a session, the following applies:

  • (a) Where cancellation occurs due to circumstances within WMF's reasonable control, a make-up session or account credit will be provided.
  • (b) Where cancellation occurs due to circumstances genuinely beyond WMF's control, including venue closure, public health restrictions, or force majeure events, WMF will use reasonable efforts to provide a make-up session. Where a make-up session cannot be arranged within 30 days, a pro-rata credit will be applied to the Parent's account.

WMF's liability for any cancelled session is limited to the value of that session only. This clause does not affect the Parent's statutory rights under applicable consumer law in each jurisdiction.

4.2 WMF is not liable for any loss or damage arising from cancellations.

4.3 Subscriptions must be cancelled at least two weeks before renewal through the Parent Area.

4.4 No refunds or credits will be issued except as stated in Section 3.4.

4A. Customer Service Payment Support (Global)

WMF's Customer Service team may contact Parents regarding failed, pending, or overdue payments for the purpose of assisting with account resolution. Support may include sending payment links, explaining how to update payment methods, and providing general guidance to help ensure accounts remain up to date.

All payments must be completed directly by the Parent. WMF staff will not collect, input, or process payment information on behalf of any Parent.

5. Parent Responsibilities

5.1 The Parent warrants that:

  • (a) All enrolment details are accurate and kept up to date.
  • (b) Where a Carer remains on the Premises during a session, the Carer is responsible for supervising the Player at all times outside of active coaching. Where a Parent has consented to the Player attending a session or camp without a Carer present, WMF accepts responsibility for the duty of care of the Player during the supervised session or camp period only. WMF's duty of care is limited to the designated coaching environment and session hours. WMF is not responsible for the Player outside of those times or that Premises. WMF will operate in accordance with applicable safeguarding standards in each jurisdiction, including FA Safeguarding Standards (UK), state child protection legislation (Australia), COPPA 2.0 duty provisions (US), and Wadeema's Law (UAE).
  • (c) The Player is supervised at all times by the Carer while on the Premises.
  • (d) The Parent indemnifies WMF against any losses or liabilities caused by the Parent, Carer, or Player.
  • (e) WMF is not responsible for lost or stolen property.

6. Discipline

6.1 WMF may exclude a Player or Carer for unacceptable behaviour at its sole discretion.

6.2 WMF determines the standard of acceptable behaviour.

6.3 Players must follow the Player Code of Conduct.

6.4 Parents must follow the Parent Code of Conduct.

6.5 Parents must collect children promptly; WMF may contact authorities if delays present safeguarding concerns.

6.6 WMF may refuse further training to anyone who breaches conduct or safeguarding policies.

7. Liability

7.1 Except in cases of fraud or negligence, WMF is not liable for any loss, damage, or delay connected to the Course.

7.2 Claims must be raised within 15 days of the event.

7.3 Maximum liability shall not exceed the Fee paid.

7.4 Parents understand and accept inherent risks of sports participation, including injury or illness.

7.5 Parents waive all claims against WMF except where limited by law.

7.6 WMF maintains public liability insurance covering third-party bodily injury or property damage arising from WMF's negligence during sessions. WMF does not provide personal accident insurance, private health insurance, or medical coverage for individual Players. Parents are responsible for maintaining any personal accident, health, or medical insurance they consider appropriate for their child's participation in physical sporting activity. Nothing in this clause limits WMF's liability for injury caused by WMF's own negligence.

7.7 Parents must disclose any medical or psychological conditions relevant to participation.

8. General

8.1 Notices must be sent by prepaid post or email. Notices are deemed received 72 hours after posting or 24 hours after emailing unless they bounce.

8.2 Failure to enforce any clause does not constitute a waiver of rights.

8.3 These Terms represent the full agreement between WMF and the Parent.

8.4 WMF may amend these Terms with 30 days' notice; continued participation constitutes acceptance.

8.5 Parents may not transfer rights or obligations without WMF consent.

8.6 Governing law and jurisdiction vary by country (see supplements).

9. Health & Safety

9.1 WMF may implement health and safety measures in response to public health guidance.

9.2 Parents must review WMF's current health and safety policies before booking.

9.3 WMF may cancel or reschedule classes due to public health restrictions.

10. Photography, Filming and Image Use

10.1 Scope

This section applies to all photography, video recording, and image capture of children under 16 years old participating in WMF programs.

This includes weekly training sessions, trial sessions, Fun Flair Festivals, and all other WMF activities.

No photography, filming, or image capture of any child will occur without explicit parental consent obtained at registration.

10.2 Consent at Registration

Explicit parental consent for photography and filming is obtained through the registration process.

By completing registration, the Parent confirms they have read and understood the Photography Policy and Privacy Policy.

Consent is collected via the registration system with separate consent selections for:

  • (a) Photography and video recording for internal training, safety, and coaching analysis
  • (b) Photography and video recording for social media and marketing use
  • (c) Photography and video recording for scouting purposes and sharing with professional football clubs

Each consent category requires an active selection by the Parent.

No consent option is pre-selected.

The Parent must provide a response to each consent category to complete registration.

Registration constitutes documented consent for audit and compliance purposes.

10.3 Consent Record

The registration system records the following for each consent selection:

  • (a) Parent name and verified email address
  • (b) Child name and date of birth
  • (c) Consent selection for each category (YES or NO)
  • (d) Timestamp of consent
  • (e) Program or event registered for

Consent records are retained for the duration of enrolment plus five years.

Consent records are available for regulatory audit upon request.

10.4 Effect of Consent Selections

Where the Parent selects YES to a consent category, WMF may use the child's image for that specified purpose.

Where the Parent selects NO to a consent category, WMF will not use the child's image for that purpose.

Selecting NO to any consent category does not prevent the child from participating in WMF programs.

Selecting NO to social media consent does not affect scouting consent and vice versa.

10.5 Device Policy

All photography and filming at WMF sessions and events must be conducted on WMF-owned or WMF-approved devices only.

Personal mobile phones and personal recording devices are prohibited for capturing images of children during sessions.

This applies to all WMF staff, coaches, and contractors.

Parents and carers may photograph or film their own child only.

Parents and carers must not capture identifiable images of other children without the consent of those children's parents.

10.6 Social Media and Marketing Use

WMF may use photographs and videos of children for social media and marketing only where the Parent selected YES to social media and marketing consent at registration.

Social media channels include but are not limited to Instagram, Facebook, TikTok, YouTube, and franchise-specific accounts.

Marketing use includes but is not limited to website content, promotional materials, flyers, email campaigns, and advertisements.

WMF will not:

  • (a) Tag or identify any child by name without separate explicit consent
  • (b) Share any child's personal information including school, home address, or contact details
  • (c) Use images in any context that could harm the child's dignity, privacy, or wellbeing
  • (d) Sell or license images to third parties for their commercial use

Where consent was not provided at registration, WMF will make reasonable efforts to exclude the child from photographs and video.

In group or wide-angle shots where exclusion is not possible, WMF will not publish images where the child is identifiable.

10.6A VeoCam Session Recording

Where VeoCam cameras or equivalent automated recording technology are in operation at a WMF venue, sessions at that venue are recorded. Not all WMF venues operate automated session recording. Parents will be informed at or prior to registration whether session recording is in use at the specific venue where their child is enrolled.

Where session recording is in operation, purposes are:

  • (a) Coaching analysis and player development
  • (b) Safeguarding and safety documentation
  • (c) Quality control and coach training
  • (d) Parent access to review their child's progress

Parent access: Parents will be granted access to the relevant platform to view footage of their own child only. Parents may not share footage that includes other children without those parents' consent.

Data protection: Footage is stored securely and access is restricted to authorised coaches, relevant Parents, and WMF administrators. Full details are provided in our Privacy Policy Section 5.1A.

Legal basis: WMF processes session recording footage under legitimate interest as it is necessary for service delivery, quality assurance, and child safety.

Right to object: Parents may object to session recording by contacting [email protected]. Where WMF cannot reasonably deliver coaching or safeguarding obligations without recording at that venue, continued enrolment may not be possible.

Separate from marketing: Session recording footage is for internal coaching and parent access only. Use of any footage for marketing or social media requires separate explicit consent as set out in Section 10.2.

Where session recording is not in operation at a venue, this section does not apply.

10.7 Scouting and Professional Club Sharing

WMF operates scouting programs in partnership with professional football clubs.

WMF uses VeoCam and similar recording technology to capture session and event footage for scouting review.

Footage is shared with professional clubs and scouts only where the Parent selected YES to scouting consent at registration.

Where scouting consent was provided at registration:

  • (a) Footage may be reviewed by WMF-affiliated scouts
  • (b) Footage may be shared with professional club academies
  • (c) Scouts or clubs may contact parents directly if interested in a player

Where scouting consent was not provided at registration:

  • (a) The child's footage will not be shared externally
  • (b) The child's footage will not be flagged for scout review

10.8 Internal Use

WMF may record sessions for internal purposes including:

  • (a) Coach training and quality assurance
  • (b) Safeguarding and incident review
  • (c) Performance analysis for coaching staff only

Internal use footage is stored securely and is not published externally.

Internal recording requires the Parent to have selected YES to internal use consent at registration.

Where consent was not provided, the child will be excluded from internal recordings where reasonably practicable.

10.9 Withdrawal of Consent

Parents may withdraw consent for any photography, social media, marketing, or scouting use at any time after registration.

Withdrawal requests must be submitted to [email protected].

Withdrawal requests must include the child's name and the consent category being withdrawn.

Upon receipt of a withdrawal request:

  • (a) WMF will update the consent record in the registration system
  • (b) WMF will cease using new images of the child for the withdrawn purpose immediately
  • (c) WMF will remove existing images from social media channels within 30 days
  • (d) WMF will retain images only where required for safeguarding, legal, or regulatory purposes

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

Withdrawal of photography consent does not affect the child's ability to participate in WMF programs.

10.10 Updating Consent

Parents may update or withdraw their consent selections at any time by emailing their local WMF franchise with their request, copying [email protected]. Withdrawal and update requests must include the child's name and the specific consent category being changed.

WMF will use reasonable efforts to action consent changes promptly. Consent changes are not guaranteed to be processed instantaneously.

Updated consent applies to future image capture and use only. Previously published content will be removed upon request within 30 days of confirmation of the withdrawal. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal. Withdrawal of photography consent does not affect the child's ability to participate in WMF programs.

10.11 No Photo Identification

Parents who select NO to photography consent may request a No Photo identifier for their child.

The identifier will be provided at check-in for events and communicated to coaches for regular sessions.

WMF staff will make reasonable efforts to exclude identified children from all photography and filming.

Incidental inclusion in wide-angle or group shots may still occur despite reasonable efforts.

10.12 Retention of Images and Footage

Session and event recordings are retained for a maximum of three years.

Social media posts featuring children will be reviewed annually and removed where consent has been withdrawn.

Scouting footage shared with external clubs becomes subject to the receiving club's data retention policies.

WMF is not responsible for footage retention by third-party clubs after sharing.

10.13 Dignity and Privacy Protection

All photography and filming must respect the dignity and privacy of the child.

WMF will not capture or publish images that:

  • (a) Depict a child in distress, injury, or embarrassment
  • (b) Could be used to identify a child's location, school, or personal circumstances
  • (c) Could affect the child's reputation or wellbeing
  • (d) Could be misused or taken out of context

WMF reserves the right to reject or remove any image that does not meet these standards.

10.14 Safeguarding Override

Safeguarding concerns override all marketing and promotional considerations.

Where a safeguarding concern is identified:

  • (a) WMF will immediately cease publication of relevant images
  • (b) WMF will review all images featuring the affected child
  • (c) WMF will cooperate with relevant authorities as required

WMF staff must report any concerns about image misuse to the designated safeguarding lead.

10.15 Personal Data in Images

Personal details including the child's name, contact information, school, or address will not be shared alongside images without separate explicit consent.

Name tagging on social media requires separate explicit consent beyond social media photography consent.

WMF will not respond to third-party requests for child identification from published images.

10.16 Verifiable Parental Consent

Parental consent is verified through the registration system which requires:

  • (a) Verified parent or guardian email address
  • (b) Active selection of each consent option (not pre-checked boxes)
  • (c) Timestamp and record of consent maintained for legal compliance

For children under 16 in the United States, verification steps are implemented in compliance with COPPA 2.0.

For United Arab Emirates registrations, additional verification is implemented in compliance with Federal Decree Law No. 26 of 2025.

10.17 Jurisdiction-Specific Compliance

United Kingdom

  • Consent obtained at registration satisfies UK GDPR and Data Protection Act 2018 requirements
  • Online Safety Act requirements for identifiable children are met through granular consent selection
  • Company-owned devices only for all photography and filming by staff
  • FA safeguarding standards apply to all image capture and use

United States

  • Consent obtained at registration satisfies COPPA 2.0 requirements for children under 16
  • Verifiable parental consent is obtained through email verification and active consent selection
  • State-level privacy protections apply where stricter than federal law
  • Data minimization principles apply to all image collection

Australia

  • Consent obtained at registration satisfies Privacy Act 1988 and Australian Privacy Principles
  • Registration consent constitutes written consent for commercial image use
  • Purpose disclosure is provided at point of consent collection through linked Privacy Policy
  • Children's images are treated as sensitive information

United Arab Emirates

  • Consent obtained at registration satisfies Federal Decree Law No. 26 of 2025 (PDPL)
  • Explicit and verifiable parental consent is obtained through the registration process
  • Sharenting restrictions are addressed through granular consent options
  • All image use must not affect the dignity or privacy of the child
  • WMF complies with Wadeema's Law child protection requirements

10.18 Privacy Policy

Full details on photography data processing are available in the WMF Privacy Policy, Section 5.

The Privacy Policy and these Terms and Conditions are aligned and must be read together.

In the event of conflict between these Terms and the Privacy Policy regarding photography consent, the stricter requirement applies.

11. Data Protection

11.1 WMF collects and retains personal data for bookings, training, and safeguarding.

11.2 Data may be shared with trusted service providers or successors to WMF.

11.3 WMF maintains industry-standard data security safeguards.

11.4 Parents may request access, correction, or deletion of their data.

11.5 Full details are available in the WMF Privacy Policy.

12. Payment Retry (Global)

Payment Retry Authorization

By enrolling in a WMF subscription or making any recurring payment, the Parent provides explicit consent for WMF to securely store payment credentials through PCI-DSS compliant processors (e.g., Stripe, GoCardless). WMF does not store raw payment details.

Retry Attempts

WMF may make up to three (3) automated retry attempts within 14 days for any failed payment.

Scope of Authorization

Retry attempts apply only to:

  • (a) subscription fees;
  • (b) renewal charges;
  • (c) outstanding amounts from previous failures;
  • (d) fees agreed at the time of booking.

Customer Rights

Parents may cancel future payments or withdraw retry consent through the Parent Area, subject to Section 4. Any outstanding amounts remain payable.

Notice Requirements

WMF will notify Parents of failed payments and upcoming retry attempts. Where required by local law, WMF will also give advance notice of subscription renewals.

Parent Responsibilities

Parents agree to:

  • keep payment methods valid and up to date;
  • ensure sufficient funds;
  • update expired or replaced cards promptly.

No Additional Fees

WMF does not charge fees for retry attempts. Bank/provider fees remain the Parent's responsibility.

Compliance

Retry attempts comply with all applicable privacy laws, including UK GDPR, DPA 2018, CCPA, UAE PDPL, and the Australian Privacy Principles.

Updates to this Payment Retry section will be communicated via the Parent Area and apply to future payments only.

13. Inclusion, Support & Reasonable Adjustments

13.1 We Make Footballers is committed to providing an inclusive and welcoming environment for all participants.

13.2 Our sessions are delivered in a group coaching format, with a typical coach-to-player ratio of approximately 1:10. As a result, our programmes are designed to provide general football coaching, rather than individualised or specialist support.

13.3 In line with applicable disability and inclusion laws (see Jurisdiction-Specific Supplements), we will consider and, where appropriate, make reasonable adjustments to support a child's participation. What is considered reasonable will depend on the individual circumstances of each session and child, including safety considerations and the practical resources available within a group setting.

13.4 However, we are not able to provide one-to-one supervision, specialist coaching, medical care, behavioural support, or therapeutic provision as part of our standard sessions. We cannot guarantee that all individual needs can be fully accommodated within a group-based coaching environment.

13.5 Where we reasonably believe that a child's needs cannot be safely or effectively met within our standard session structure, we may discuss alternative options with parents or carers or, where necessary, decline or discontinue participation in the best interests of the child, other participants, and our staff.

13.6 Parents and carers are responsible for informing us of any relevant medical conditions, disabilities, or additional needs so we can assess whether our programme is suitable.

13.7 Nothing in this section is intended to limit or override our obligations under applicable disability and inclusion laws.

Jurisdiction-Specific Supplements

United States

  • Governing Law: State where the academy operates
  • Refunds: Only where required by state consumer law
  • Inclusion: In line with the Americans with Disabilities Act 1990 (ADA), WMF will consider and, where appropriate, make reasonable modifications to support participation. See Section 13.
  • Privacy: WMF complies with COPPA 2.0 for children under 16, CCPA, and applicable state laws
  • Photography: Verifiable parental consent required; data minimization principles apply

United Kingdom

  • Governing Law: Laws of England and Wales
  • Inclusion: In line with the Equality Act 2010, WMF will consider and, where appropriate, make reasonable adjustments to support participation. See Section 13.
  • Safeguarding: WMF follows FA safeguarding standards
  • Privacy: Compliant with UK GDPR, DPA 2018, and Online Safety Act
  • Photography: Company-owned devices only; explicit parental consent required at registration

United Arab Emirates

  • Governing Law: Laws of the Emirate of operation
  • Inclusion: In line with UAE Federal Law No. 29 of 2006 concerning the Rights of People of Determination, WMF will consider and, where appropriate, make reasonable accommodations to support participation. See Section 13.
  • Safeguarding: Compliant with Wadeema's Law
  • Privacy: Compliant with Federal Decree Law No. 26 of 2025 (PDPL) and Federal Data Protection Law No. 45 of 2021
  • Photography: Explicit and verifiable parental consent required; sharenting restrictions apply; dignity and privacy protections enforced

Australia

  • Governing Law: Laws of the state/territory of operation
  • Inclusion: In line with the Disability Discrimination Act 1992 (DDA), WMF will consider and, where appropriate, make reasonable adjustments to support participation. See Section 13.
  • Safeguarding: Compliant with state child-protection laws and WWCC
  • Privacy: Compliant with the Privacy Act 1988 and APPs
  • Photography: Registration consent constitutes written consent; children's images treated as sensitive information
